nevada. partly cloudy, there are breaks, breezy and windy. evening but still it will be blustery for a few. especially the higher elevations. a cooler monday. sierra snow, highs for us 50s and low 60s. 30s and 40s. santa rosa 39. low 50s for some. cloud cover keeping temperatures up. cloudy skies starting, and a few sprinkles earlier. a high of 62. may not feel that warm. i mean it's going to be a cool breezy day. san francisco, some breaks in the clouds already. a high of 59 today. so temperatures 50s and 60s coast, bay or inland. they're not going to change too much. this low will be out of the picture by tonight, tomorrow, and we'll have to deal with cold mornings, but improving days. cooler, breezy, light rain east and south. there are a few locations that stay calm. 60s, here's the fabulous tara. >> we want to mention that we have back up in the east bay in

lafayette. highway 24, westbound. an accident on 680 southbound. this is what you're looking at. the chp lights. this is a two car crash, definitely back up. it's kind of behind where the shot is. you can't see the extent of it. give yourself extra time if you need to take 60 southbound through the walnut creek area. 880, you can see traffic on the left side of your screen southbound. we want to mention in the northbound lanes, just north of high street, we have a car versus a truck with a trailer and it's blocking a lane of traffic. the tow truck is on the way. that guy is stuck in traffic too so it's going to be a while. last but not least, we have a look at the bay bridge. the metering lights are on here. back up congestion. give yourself 20 minutes to get into the city. a high wind advisory, hasn't been listed yet. we'll keep you post the. 7:03. back to the desk. wed win with developing news from san jose.

police are -- we begin with developing news from san jose. police are on the scene of a suspected drunk drive. janine de la vega got new information about the suspect and the victim and she joins us now live from san jose. good morning. >> reporter: good morning. we know that they are friends, the suspect and the victim in this accident. police are talking to the suspect back at the police station interviewing her. she was behind the wheel of the suv that with see parked in that driveway. we're being told that the driver was drunk at the time. one of the questions that we wanted to find out from officers is did she know she hit her friend. was she trying to help. police were called to weeble way after a neighbor called to say that a woman was crying outside. when officers arrived, they found the suv and next to it a 26-year-old woman seriously injured. she died at the scene.

it appears the driver backed into the garage hitting it and her friend. it's unclear where the victim was standing at the time, but police believe prior to getting hit that she was a passenger in the car. police have arrested the 27- year-old driver. >> when the officers did arrive here, they did suspect that she was driving under the influence immediately, so that led them to believe, again, that she was pretty intoxicated. >> there are some indication that there was some beer there. whether it was in the vehicle or near the area. >> reporter: the driver was arrested for vehicular manslaughter and driving under the influence. it's unknown if the victim or the suspect live at the condo where the accident happened. we haven't seen anyone come in and out of that home yet. now, this is the 21st vehicle versus pedestrian accident that has resulted in a fatality. and we were told by a police spokesman that that's the highest number it's been in the past five years in san jose. reporting live from san jose.

janine de la vega, ktvu channel 2 news. time now 7:05. happening right thousand. cleaning up a big overnight mess caused by strong winds in addition to knocking down trees and power lines, the wind caused havoc on the roads all over the bay area. ktvu's christien kafton joining us in the altamont pass. and you have seen big rigs knocked over. >> reporter: yeah, still a lot of work to get the roads cleared. we're on i-580 east of mountain house parkway. we saw one big rig on the road, two miles up the road to the west of where we are. this one still on its side right here. we have video of the husband and wife who did manage to get out of this. we'll show that to you in just a few moments. we can tell you the winds have largely died down here but there are still occasional gusts that. started around 9:30 near

mountain house parkway. 5 big rigs and one pickup truck overturned overnight. again, we have the video of the driver and the wife of the big rig here that overturned. that couple was on their way from last to livermore. we are 20 -- los angeles to livermore. one person was hurt in the series of accidents and big rig drivers tell us this is the season when the high winds whip up. >> give yourself a little bit of time, you starting getting into things like that, in a rush, tailgating, stop opt brakes and change lanes real quick and newscast all it takes, that gust of wind, 40, 50 miles per hour, all of a sudden comes off the pass and it's all it takes. >> reporter: and the advice from professional driver to those of us who are sharing the road. again, not just a problem for big rig drivers but of course for anyone hitting the road. you can see how lucky the drivers were able to get out of, apparently the cds or the

windshield of the obeying rig -- driver's side or the windshield of the big rig here. we are continue to go check the california highway patrol cab web site to see if there are any updates about more wind related accidents this morning. we'll bring you those update z as the morning continues. for now, live at the altamont pass, christien kafton ktvu channel 2 news. and high winds toppled a tree this antioch and it crashed through the roof of a house last night at 6th and elm street. a man was sitting on a bed when the tree came crashing down. that man was taken to a hospital for scratches on his arms and his back. it was also a child in that room, but the child was not hurt. 7:08. high winds knocked out power to 15,000 bay area homes and businesses last night. in san francisco, scaffolding toppled down on power lines on hyde street and 5500 people lost power. in the east bay, customers lost power in ant yak.

danes -- antioch, danesville. and is they rushed to 49 separate outages. most customers have power back on now and it should be fully restored by 10 this morning. while the bay area is dealing with wind, people in the sierra are waking up with snow, up to 8 inches of snow could fall in the sierra today. coming up at 7:15. we'll have a live report on the storm blanketing the sierra pass and how drivers should prepare. police in vallejo searching for the gunman that shot 8 people, killing one and wounding 7 others. it happened saturday night on princeton avenue. a group of friend from san francisco were driving in four separate cars when one of them got a flat tire. this surveillance video showed them pulling over onto a side vote. a white suv drove and you happen someone inside started shooting. i've been working here at the police department for 40 years and i have never experienced a single incident

where there have been 8 people shot. >> a 19-year-old man died there at the scene. these candles were lit in his honor. police say there's no word about a possible motive. this, by the way, was vallejo's 20th homicide of the year. a group of represents in oakland's rock ridge neighborhood, they have raised more than $20,000 to hire private security guards. one of the residents started the campaign through a crowd funding web site called crowd tilt. this started in september after an armed robbery at a casual car pool pickup stop near claremont avenue in hudson. this is just a short-term solution to the rising crime until the area. it's 7:10. the recent tragedy on the b.a.r.t. tracks may lead to a new emergency alert system for b.a.r.t. two workers had gone out to inspect the tracks near walnut creek nine days ago when they were struck and killed by a b.a.r.t. train. today's chronicle reports that deadly accident has b.a.r.t.

taking a second look at a high- tech system now used on train systems in boston and baltimore. under this system is, track workers are equipped with alarms that sound and brit -- vibrate when a train is 15 second is away. the results of a vote are expected late friday night or early saturday morning. b.a.r.t.'s board of directors would then vote on the new deal with the union workers approve the tentative agreement. a board vote would likely come during the next scheduled meeting on november 21st. it is possible it could come earlier during a special board meeting. both sides are expected to approve this deal. and the tentative agreement ended b.a.r.t.'s latest four day strike which outraged many bay area commuters. mump of the anger was focused on union workers demands for extra pay when they already make some of the highest average salaries in the state.

figures compiled shed light on the salaries. they show the raises workers receive reflect the wage bumps that other bay area government employees already got in the last few years and the b.a.r.t. raises were slightly more than the pay increases private sector workers received. time 7:11. happening today, muni in san francisco testing out a new program to increase service on the five fulton lines. it will mean a 20 to 30% increase in capacity, between the fulton street and the 6th 6th avenue stop and the temporary transbay terminal. it also means 9% of muni customers, you're going to need to walk an extra block to get picked up. 16 parking places have been eliminated. the city of san jose is cracking down on school car washes. the city's environmental services department says the popular fundraisers are often

. welcome back. time now 7:15. spain, just became the latest european country to publish allegations of americans spying. spain's newspaper says documents provided by former national security agency contractor edward snowden showed the united states and the nsa monitored 60 million phone calls in spain last december. now all this comes as a delegation from the european arrives today in washington d.c. they want answers about the latest round of purported u.s. spying activities. the guardian says the national security agency monitored the calls of 35 world leaders, including the leaders of france and germany. the allegations are coming from the documents leaked by ed yard snowden. the german media report thes a

surveillance of chancellor merkel's phone and that it started in 2002, and they say president obama was made aware of it in 2010. the nsa is denying president obama knew anything. it is 7:16. california senator diane feinstein says she supports giving the nsa limited authority to continue gathering american's telephone records to prevent attackings attack -- attacks. the committee is drafting legislation to put restrictions on the nsa phone records program. the legislation would allow the nsa to continue gathering records listing the numbers, time and duration of all u.s. telephone calls, but not their content. time is now 7:17. san francisco is getting into the battle over sugary

beverages, setting a task of 24- cents on every can of soda sold. the proceeds of the tax would pay for health, nutrition and activity programs for city youth supervisor weiner thinks the majority of voters would support the tax because it would benefit children. the change in weather here in the bay area is bringing snow to the sierra. brian hickey is in kingsville where snow has been falling most of the morning. >> reporter: take a look behind me at individual -- king yale. we have 4 to 5 inches. folks come up to the chain patrol, many unprepared for the winter driving conditions. we have seen big rig drivers, having to turn around and head back down the mountain because they didn't come up with

time is 7:32. the winds last night in antioch toppled a tree, it crashed through the roof of a house landing next a boy as they sat on a bed. allie bed -- alex savage is there to tell us more. >> reporter: as the sun is coming up in antioch, we're getting a good look at the damage in the backyard of home. it's incredible. we came back here a few minutes ago, and you can see this tree that was in the backyard, completely unrooted here and you can see it came crashing down on the house. now, there was a father and his 1 1/2-year-old son. they were sleeping in that back bedroom right there when one of the large branches from this tree punctured the roof of their home and came right into the bedroom. actually injuring the father in this case. let me show you the scene from earlier this morning. some video we shot. everything happened about 6:30 or so last night, and this home is on 6th and l streets, right as the winds picked up in this area, about that time, this

large branch from the dead oak tree came through the roof of the home. the father and his 1 1/2-year- old son were in the bedroom at the time and the branch came and punctured the roof and actually hit the father. he was treated for scrapes on his arm and back. the little boy was not hit by the branch and he was not hurt during all of this. the child's mother was in another room at the time. she ran in to find this scene, and was certainly shaken up by what she saw. and a couple minutes ago, i had the chance to speak with the little boy's aunt. she heard a loud crash inside the house as this tree toppled over. >> we're thinking that he wasn't like closer to the bed, where it could see his head or anything, and he could have died. or my nephew, because he likes playing right there. we're pretty thankful. >> a lot of problems, antioch and pittsburgh, emergency crews told us they were responding to a number of wind related calls that came in about the same time as those gusty conditions

picked up. this was really the most serious damage in this area and as we bring you back out here live this morning, you can see a lot of clean up work to do, this family is obviously going to have to take care of this large oak tree now down in the backyard, and they're going to have to do repair work to the roof. certainly everyone in this family grateful they are okay. live this morning in antioch alex savage ktvu channel 2 news. 7:34. happening now, boy, a big clean up is underway all over the bay area after the winds toppled trees, knocked out power and toppled trucks like you see here. live pictures now, we're right there in the altamont pass. would you believe at least 6 big rigs were flipped over by those strong winds. at least one person was hurt. the gusty winds in emeryville knocked down scaffolding that crashed down onto several cars and on the sidewalk right in front of the forever 21 and victoria secret stores on bay street in emeryville.

luckily no one was hurt. to get more information about the wind related incidents happening around the bay area go to our channel 2 web site, ktvu.com and get information about power outages and weather advisories for your area. it's 7:35. a shooting at an unlikely place. san francisco police opened fire on a suspect who allegedly pointed a gun at them at pierce and chestnut streets in the city's marina district. it happened yesterday afternoon. ktvu's brian flores is live to explain where they are in the investigation. >> reporter: police have that suspect in custody. in fact, he is recovering at a nearby hospital from at least one gunshot injury from police officers yesterday. in the meantime, police are examining all the evidence that they can including surveillance camera footage from the bank of america behind me here on pierce and chestnut. this happened yesterday afternoon around 12:30. right in the middle of the day. two men were involved in a fight or scuffle when police say the suspect allegedly

pistol whipped and fired shots at another man right in front of an atm at the bank of america. both men ran off. police say the victim ran into some type of blue car driven by a woman, while the suspect ran and hid in some bushes a few blocks away. when police were approaching those bushes, that's when the suspect allegedly pointed the gun at officers and that's when they opened fire to defend themselves. that suspect recovering at san francisco general in serious condition, but recovering from injuries. we did speak with residents this morning, and they are a bit shaken up. >> it's pretty shocking to see something like that happen on chestnut street because this street is normally like really safe and everybody's happy. >> reporter: now, as for the victim, we understand he was treated for cuts to the head at a castro valley hospital. while it appears this may be over, there's unanswered questions as we mentioned, did the suspect and victim know

each other. as we take you out here live, police are unsure whether this was an attempted robbery though it did take place in front of an atm at the bank of america, and there was question about the contents of a backpack carried by the victim. we have contacted san francisco police this morning who tell us at this point there is no new information. we hope to have new information, though, as the morning continues. live here in san francisco, brian flores ktvu channel 2 news catch. thank you brian. 7:37. a teenager accused of killing an off duty paramedic in oakland is scheduled to appear in court today for a preliminary hearing. the attack happened in april in the oakland hills. prosecutors say christian burton and several other teenagers pulled up behind paramedic quinn boyar and is shot him in the head. police believe he was killed during an attempted carjacking. 7:38. new this morning, san jose police want your help. they're trying to find an at

risk missing elderly woman. this is 83-year-old bong tran she has diabetes. she has short-term memory loss. she has gray hair, brown eyes. she's about 5 feet tall, weighing about a hundred pounds and goes by the nickname ma. she only speaks vietnamese. if you have any information, contact the police. tonight in san jose, the second of four public meetings about reducing gang violence will be held. the gang prevention task force was hosting a meeting at the baskin community center. residents can find out about what's happening in their neighborhood and also what the city is doing to reduce gang violence. today's meeting starts at 6:00 p.m. theater meetings will continue through -- these meetings will continue through november 14th november 14th. homeless advocates are planning a sleep in to protest the new proposals over park hours. they will meet at delores park,

two blocks south of mission delores. right now the parks are open all night. scott weiner has made a proposal to change the operator hours from 5:00 a.m. to midnight. the upcoming november 6th november 6th election in san francisco could break a record for low voter turn out. the ballot will feature the 8 washington street proposal which would bring luxury condos to san francisco owe water front. it's the first referendum on the ballot in 20 years, and has attracted the most strident opinions on both sides. even though so, this is an add year election and many candidates on the ballot are running unopposed. next week, antioch residents will vote on a half cent sales tax hike to beef you have the police department. it's expected to raise $4.3 million annually. it would add 20 new police officers and at least double the current staff of 3 city

workers, a janitor and two cooks, started to worry about the patients care. they were the only ones that stayed with the patients at the nursing home. >> how can anybody do that, we're talking human beings, how do you just abandon them. >> sheriff's deputies found 14 sick and elderly patients, some amputees, some with dementia. investigators are considering filing elder abuse charges against the owner of the facility. ktvu news spoke to the attorney for the owner. the lawyer would only say that his client is getting out of the nursing home business, but, again, we are weight to see -- waiting to see if criminal charges will be filed. reporting live in the news room, pam cook ktvu channel 2 news. classes rule today after a deadly shooting in sparks school. there will be extra police officers, grief counselors to help the students at sparks middle school deal with what happened. a 7th grader is accused of killing a math teacher and

wounding two other students before killing himself. police say they don't have a motive and they don't know whether the shooter chose his victims at random. it's 7:47. nato officials say they are planning a smaller post war mission in afghanistan. according to the new york times, there will be fewer combat trainers and more military managers to make sure the billions of dollars in security aid are used widely. the paper says unless american and nato troops are there to oversee how the money is spent, it will be hard to account for it in a country known for corruption. the syrian government met a deadline it to submit a detailed declaration of a chemical weapons facilities and the proposal for destroying the weapons. the group overseeing the destruction says the plan drafted by the u.s. and russia is proceeding on schedule. time now 7:48.

wow, look at this, high wind, high waves, strong winds off the coast of england. this is postponing a search for a teenage boy who was september -- swept out to sea. the boy was playing in the surf caused by one of the worst storms of the year. that storm has disrupted air and train travel around england. the forecasters expect the weather to get even worse before it gets better. back in this country, the doctor convicted in michael jackson's death just got out of jail. this is the scene outside of the jail when dr. conrad murray was released. he walked out of the la county jail shortly after midnight. he served about half of his four year sentence.

back in 2011, a jury found dr. murray guilty of giving a deadly dose of the painkiller, propofol to michael jackson. he was convicted of involuntary manslaughter. and grammy award winning singer chris brown is expected to appear in a courtroom in washington d.c. yesterday chris brown and another man were charged with felony assault. police say they attacked another man early sunday morning. the victim had to be taken to the hospital for his injuries, but police say he was released later yesterday. chris brown's lawyer and his publicist have not made any comments yet. it's 7:56. a contractor at the new 49ers stadium in santa clara is due in court on charges of stealing copper wire. prosecutors say 37-year-old vincent latona stole more than $5000 worth of copper wire going as far back as 2009.

>> reporter: , you know, we are still trying to figure that out. police say it doesn't appear there were too many witnesses, maybe only the two involved and one of them is dead. now, the coroner just arrived here on the scene about 5 minutes ago. they're here to examine the body that was found on the rear passenger side near the tire. investigators just told us that they have determined that the driver backed up into her friend. police were called to this town home near lee and hamilton in west san jose f after a neighbor heard a woman crying outside. they found the woman lying in the driveway of a town o home next to the suv badly injured -- town home next to the suv badly injured. she died of her injuries. police say it appears the 26- year-old victim had been a passenger in the car. it's unknown why she got out of the car. officers suspected that the driver was drunk and they took her into custody. police say the number of

vehicle versus pedestrian accidents is rising. >> last year we had 20 and i think within the last 5 years, i think 21 is the highest we have had in the last 5 years, maybe longer than that. that is the most disturbing number that we look at. >> reporter: police found beer cans at the scene. again, they arrested the 27- year-old driver for suspicion of driving under the influence and vehicular manslaughter. it's unknown if the victim or the suspect liver at the town home where the accident happened. we do know that that victim is 26 years old. we have been unable to get closer, you know, to the house to talk to the other neighbors to see if they know who lives there just because police still have this scene roped off. reporting live from san jose, janine de la vega, ktvu channel 2 news. time is 8:04. happening now, we're also tracking damage from high winds all over the bay area. look at this.

ktvu's christien kafton live in the altamont pass where the strong winds knocked over half a dozen big rigs overnight. good morning. >> reporter: good morning, we're just on i-580 east of mountain house parkway. there's one big rig that is still toppled over. that's about 2 miles to the west of us here, and of course this one that you see still on the side of i-580. the driver and his wife did manage to make it out of this rig. if you take a look, you can see the front windshield appears tophic knocked out. it appears they punched they way out through the front windshield. it happened around 9:30. at least 5 big rigs and one pickup truck overturned overnight. again, we have video of that driver and his wife getting out. so we know at least they were safe. we did hear that another driver may have been injured overnight. the driver of this big rig on

his way from los angeles to livermore and we're 20 miles out from livermore and this is where he flipped over last night. we did imagine to -- manage to find a big rig driver this morning, and he said this is the season when the high winds whip up along the altamont pass. >> it's that time of year. the season changes, the storms come over and come through the path and narrows down pretty good and is you end up having a lot of wind all of a sudden. >> reporter: now, professional drivers are warning the rest of us not to make sudden lane changes in high winds like we saw last night. that could be dangerous for the average driver and could force big rigs like this one to make sudden adjustments making things tougher for big rig drivers as well. if you are going to be on the roads today, watch out for gusty conditions occasionally here along the altamont pass. live in the altamont pass, christien kafton ktvu channel 2 news. those overnight winds knocked out power to 15,000 bay area homes and businesses. in san francisco, scaffolding

fell down on the power lines on hyde street. 5500 people lost their power. in the east bay, customers lost power in antioch, danville, and on the peninsula, pg&e crews rushed to 49 separate outages. most customers have their power back on uh-huh now. it should all be -- back on now. it should all be fully restored by 10:00 this morning. to get more information on the power outages, go to our ktvu web site. ktvu.com and get information on wind related incidents and any weather advisories for your area. vallejo police are still searching for the gunman who shot 8 people killing one of them. it happened saturday night on princeton avenue in vallejo. a group of friends from san francisco was driving in pharaoh different cars when one got a flat tire. surveillance video shows them pulling over. a white suv drove up and someone opened fire.

>> i've been working here at the police department for 40 years, and i have never experienced a sing is l incident where there have been 8 people shot. >> a 19-year-old man died at the scene. neighbors have lit candles in his honor. police say there is no word on a possible motive. this was the city's 20th 20th homicide. recent tragedy on the b.a.r.t. tracks may lead to a new emergency alert system for the entire b.a.r.t. system. two b.a.r.t. workers were inspecting tracks near walnut creek 9 days ago when they were hit and killed by a b.a.r.t. train. today's chronicle reports that deadly accident has b.a.r.t. taking a second look at a high- tech system now used on train systems in boston, and baltimore. under that system, track workers are equipped with alarms. they sound and they vibrate when a train is 15 15 seconds away. b.a.r.t. unions are supposed to vote on

friday about a contract. the results are expected late friday night or early saturday morning. they would then vote on a new deal if the union workers approved the tentative agreement. the board vote will probably come during the next scheduled meeting on november 21st. it's possible it could come earlier during a special board meeting. both sides are expected to approve the deal. now, this tentative agreement ended the latest 4-day strike which angered a lot of bay area commuters. a lot of anger was focused on the union workers and demands for pay, when they earned the highest average salaries in california. figured compiled by the san jose mercury news shed new light on the salaries. they show the raisers b.a.r.t. workers receive reflect the wage bumps that other obey area government employees already received in the last few years. and the b.a.r.t. raises were only slightly more than the pay raises private sector workers were receiving.

8:09. happening today, muni is launching a pilot program to test increased service on the 5 fulton line. muni says the program will mean a 20 to 30% increase in capacity during peak hours between the fulton street and 6th avenue stop and the temporary transbay terminal. the changes mean 9% of customers will need to walk an extra block for pickup. 16 parks spaces along the road have been eliminated. time's 8:10. the city of san jose is cracking down on the car washes, unless certain rules are followed. the city's environmental services department says student car washes violate water discharge laws. they say anything that's not storm water or rain water is considered a pollutant. any schools that want to hold a car wash, they have to make sure their water does not run into the drains. that could mean holding the car wash away from any drains, pumping the water to another location or spending the money

it is 8:13. lawmakers from the european union are in washington. they want an explanation from top u.s. officials after a newspaper reported the nsa listened in on phone calls of key u.s. allies. ktvu's kyla campbell is live in our washington d.c. news room to let us know what's expected at today's meeting. >> reporter: my contacts at the white house tell me the european union leaders will meet with national intelligence and security officials today. the guardian newspaper reported that the nsa listened in on phone calls of 35 foreign leaders, including key u.s. allies. the white house says it learned of the program this summer after former nsa contractor edward snowden leaked

intelligence about spy programs. the administration says it halted some of the tapping, including of germany chancellor's merkel's cell phone. and one said president obama should stop apologizing and is being defensive. >> the reality is the nsa has saved thousands of lives, not just in the united states but also in france and germany and throughout europe. >> reporter: and spanish media reports the nsa monitored 60 million phone calls in that country in just one month. how this could affect u.s. foreign policy on fighting terrorism and is other key issues, we expect to hear more on the white house news conference scheduled to begin in 90 minutes kyla campbell ktvu channel 2 news. and diane feinstein plans to give continued authority. she heads the senate select

committee on intelligence. they are drafting legislation to put restrictions on the nsa phone records program. the legislation would allow the nsa to continue gathering records listing the numbers, time and duration of all u.s. telephone calls but not their content the. time is 8:15. well, this week marks the first anniversary of superstorm sandy. one of the nation's worst natural disaster. this morning historic ellis island will reopen for the first time since that big storm slammed into new york harbor. superstorm sandy ravaged the island, left it without power for several months. the clean up work is far from over despite the reopening today. ellis island is best known as you know for ushering millions of immigrants into the united states over the years. now, a lot oaf us also remember this, remember this, the scene of superstorm sandy, slamming into the famous jersey shore, a year ago. the governor of new jersey admits there have been a lot of major delays getting help to the victims of sandy.

the governor chris christie maintains his administration is not to blame. he says it took congress three months to finally approve the 51 billion-dollar relief package for those sandy victims. also happening today, back here at home, governor brown is scheduled to announce an agreement between western states and brit british columbia to fight climate change. the agreement is expected to involve standards for reducing greenhouse standards. officials say the agreement is significant because a combined economy of western states and british columbia makes it the 5 5th largest in the world. it's 8:17. in 45 minutes, the trial is set to begin in san mateo county for former 49er and raider, harris. harris is accused of assaulting his boyfriend during an argument at a menlo park restaurant last january. the former offensive tackle admitted he was gay shortly after the incident and said he

kept his sexuality a secret during his entire pro football career. harris played 5 seasons for the 49ers and won with the raiders. celebrity chef fiati is expected in a marin county courtroom. around 1:30 he'll be testifying against the teen accused of stealing his lam -- lamborghini. in april of 2012, wade shot at a girl and her then boyfriend. wade was upset the girl did not have romantic feelings for him. time is 8:18. the state senate is about to hold a hearing on pg&e's analling pipeline system -- aging pipeline system. after they won approval to run a pipeline under san carlos back online after an engineer raised concerns about its safety. this pipeline explosion and fire in san bruno killed 8 people and destroyed 38 houses.

department workers accused of running over and killing a woman in holly parks is due back in court. thomas bernasky pled not guilty to charges of felony manslaughter and hit-and-run. he veered his parks department truck off a path and hit christine on september 25th as she was sunbathing with her baby and dog. his lawyer says he swerved onto the grass to avoid hitting a dog. it is 8:25. a family from danville who made strides in toughening the state's dui laws is going after prescription drug abuse. nearly 10 years ago, the pack family lost their 10-year-old son troy, and 7-year-old daughter alana to a drive who was drunk and high on vicodin. police say the driver had convinced several doctors at the same hospital to prescribe the pills, a practice called doctor shopping. >> it never goes away, and i don't think it's ever going to

you. that's congresswomanning up in a live -- that's coming up in a few minutes. we are going to check weather and traffic now. steve's here. >> i am indeed. snow continues in the sierra. just heard sugar bowl has had 15 inches at the summit and a foot at the base. that's good news. we are seeing gradual improvement. sunny in the north bay, very cool, mostly cloudy partly sunny. clouds will start to roll back in later this afternoon. breezy to windy. nothing like we had sunday afternoon, the low though up in the sierra snow there, advisory until 4:00. that's good. again, some of the amounts now coming, could top 16 inches at the summit. producing good snow there. not much in the way of rain there. 30s, 40s and 50s some light rain. santa cruz mountains, and little bit into the san jose valley. don't be surprised if clouds develop later this afternoon.

light rain to the south, that's starting to wane a little bit. sun and clouds, possibility of a shower or two. mainly it's very cool today with 50s and 60s. here's tara. thanks steve, caltrain is telling passengers to expect delays because of the broken down train. one of the southbound trains broke down and stopped short of the san mateo station. give yourself extra time. let's look at 101 through san francisco. a little bit slow going there, southbound on the right side as you make your drive toward the airport, no major delays in the city, except for 19. that's slow going. this is a look at the san mateo bridge and we haven't been able to see it pretty much all morning because of the fog. so as traffic is looking all right at this hour, a little sluggish as you make your way over to foster city. finally, we have 237, mill pitas and this has looked like -- milpitas. that's been stop and go. 8:32. let's head over to the desk.

>> we have developing news right now. we're getting word, a power outage on treasure island. the lights went out at 8:00 this morning. we don't know how many customers are affected or when the power's going to be back on. strong winds knocked out power to the entire area last night about 7:00. thousands of other homes and businesses around the bay area lost power during the night. we have been telling you about that. we're focusing on treasure island right now, a power outage hit that area around 8:00. we'll bring you more details as they're available. also, high winds in antioch knocked a tree down and it crashed through the roof of a house landing right next to a man and a child sitting in a bedroom. ktvu's alex savage has been out there since early this morning. you know more about their close call alex. >> reporter: good morning dave. this giant oak tree was up rooted in the backyard of this home because of the strong

winds last night, and is you can see the damage that was done. one of the branches of this tree went smashing right through the roof of this home. now what you're looking at there where the blue tarp is, that's a back bedroom where a father and is his young son were in the room at this time this happened last night. relatives tell me the father jumped out of the way when this tree poked through the ceiling. still, the branch did scrape his arms and back, and he did have to be treated by paramedics. the tree missed the man's 1 1/2- year-old son. he was not hurt during all of this. it all happened at 6:30 at a home near 6th and l streets in antioch. the boy's mother was at home at the time and she was in another room when the tree came down and she was stunned when she saw this tree inside her house. i saw my boyfriend, and he was hugging my baby, and so he got out, and i told him what's wrong, and i saw his shirt ripped off and then i was

brandishing a gun is is shot by police right in the middle of afternoon. ktvu's brian flores is live on pierce and chestnut with an update on the investigation. good morning brian. >> reporter: good morning, yeah, that suspect is currently recovering at san francisco general hospital by being shot at at least once by sfpd. i did get off the point where they said, at this point at this hour, no new information, they are continuing to investigate. we are hoping to get ideas of the suspect and victim later on today. this happened at 12:30 yesterday afternoon. two men were involved in some type of fight when police say the suspect who's only described as a latino man allegedly pistol whipped and fired several shots at another man in front of the atm at the bank of america on pierce and chestnut here in the marina district. soon after that, both men ran off. the victim ran into some type of blue car while the suspect ran and hid in some bushes a few blocks away.

now, police were approaching the bushes and the suspect emerged and pointed the gun at officers and they opened fire, hitting the suspect at least once, we understand the suspect did not return fire. the latest again this morning, the suspect is at san francisco general in serious condition. we spoke with several residents this morning here who say it's just shocking to see this type of scene here. >> i'm a little worried because it's happening all over the city, and it seems to just kind of be gravitating all over in all the neighborhoods. it's coming down here now. >> reporter: now, the victim as we understand was treated for cuts to the head at a castro valley hospital. police are also working to see if the suspect and victim knew each other, even whether this was a robbery attempt, even though this did happen right in front of an atm, and there's questions on contents inside a backpack that the victim was carrying. no new information from police. we are live here from the marina district. brian flores ktvu channel 2

news. 8:37, a teenager accused of killing an off duty paramedic in oakland is scheduled to appear in court today for a preliminary hearing. the attack happened back in april in oakland hills. and this is a picture of the victim, paramedic quinn boyar. prosecutors say christian burton and several teenagers pulled up beside the car and shot him in the head. police believe boyar was killed in an attempted carjacking. time 8:38. new this morning, san jose police want your help. they're trying to find a missing at risk elderly woman. take a look at the video. this is 83-year-old tran. she has been missing since last night. she has diabetes. she has short-term memory loss. she has gray hair, brown eyes, she's about 5 feet tall, weighing 100 pounds. she goes by the nickname ma and she only speaks vietnamese. if you have any information,

call san jose police. tonight in san jose, the second of four public meetings about reducing gang violence will be held. the gang prevention task force is hosting the meetings at the baskin community center. you can find out more about what's going on in neighborhoods and also what the city is doing to control gang activity. the meeting starts tonight 6:00 p.m., the meetings continue through november 14th. it is 8:38. homeless advocates are planning a sleep in to protest san francisco's new park hour proposal. at 9:00 tonight, participants will meet at delores park two blocks south of mission delores. supervisor scott weiner has made a proposal to change the operating hours so they'll be open from 5:00 a.m. to midnight. there are 220 parks in san francisco. time is 8:39. the upcoming november 6th november 6th election in san francisco may set a record for low voter turn out.

the ballot will feature the 8 washington street proposal which will bring 134 luxury condominiums to san francisco's water front. it's the first referendum on the city ballot and it has attracted the most strident opinions on both sides, but even so, this is an odd year election, and a lot of cabinets on the ballot are running unopposed. antioch residents will take a vote on a half cent sales tax increase to beef up the police force. it's expected if approved to raise $4.3 million a year. it would add 20 new police officers and at least double the current staff of 3 city code enforcement workers. this tax would automatically expire after 7 years. city leaders say this would also pull the county out of its current financial crisis. 20 minutes before 9:00. the urban shield emergency training event is wrapping up this morning for 48 hours

straight. about 56,000 police, fire, and medical personnel have been taking part in the event. they came from all across the world to practice how to

respond to 54 different emergency scenarios. organizers say the training helps

stock market is down after climbing to record highs last week. the dow is slightly lower because of competition from generic drugs and apple reports

drunk driving suspect. ktvu's janine de la vega has been on this story since 5 this morning. you're back now, so what's the latest out there. well, there is a tow truck out here right now. it's about to haul away the suv that you see behind maine now -- behind me. we did see a case of beer. there are also beer cans in the cup holders of the front seat of that car. also, you could see that the garage is dented in that driveway, and that's where the victim was hit. let's go to some video that we have earlier. police were called to the town home near lee and hamilton in west san jose after a neighborhood woman crying outside on weeble way they found the woman crying in the driveway. officers determined that the suv appears to have backed into her and the garage.

police say it appears that the 26-year-old victim had been a passenger in the car and it's unknown why she got out of the car. but police arrested the 27-year- old driver at the scene. i do want to talk to a resident who lives nearby who actually heard the crash. his name is james mcgraw and you actually heard this accident. what did you hear? because you heard voices as well. >> yeah, it was 2:30 in the morning, and i heard what sounded like a door slam. so i have never heard anything like it before and i lived here for 5 years. i got up, took a look out the window, and is i didn't see anything because the activity was happening in front of the house and i'm on the side of the property. next thing i heard was a lady's voice, and she was saying stay with me, stay with me, stay with me, and i thought maybe it was one of my neighbors talking to maybe one of her children, and then i heard a man's voice

yelling and that was the last i heard, and i went downstairs and saw the police police cars. >> reporter: and now that you see what's happened, just shock. >> yeah, i mean, i expected more that it might be something to do with some of the transient problems we have had down by the creek, but that's not the case. this is a little something different than i have ever seen. so yeah,. >> reporter: thank you for speaking with us, james mcgraw, a neighbor who lives in the area. i want to mention that the 27- year-old driver was booked with suspicion of driving under the influence as well as vehicular manslaughter. we do know from police that the victim and the suspect were friends. reporting live from san jose, janine de la vega ktvu channel 2 news. thank you. it is 8:48. a group of residents in oakland's rock ridge neighborhood has raised more than $20,000 to hire private security guards. one of the residents started the campaign through a crowd funding web site. he was motivated after a bold crime last month. it was an armed robbery at a

casual car pickup near claremont avenue and is hudson street. neighbors are chip in $20 a month for now. but they say it's a short-term solution to rise in crime in the area. and how did this happen, that's a question asked about elderly patients left alone for days without care. pam cook is not news room with more on this disturbing story. pam. >> yes, it it. we're waiting to see if criminal charges will be filed against the owner of an assisted living facility that was shut down. the california department of social services ordered the closure of valley springs manor. this morning's contra costa times reports the that department has been investigating them for months. there have been several violationings, including a patient who was not supposed to be left outside went missing for days. also a diabetic patient

received a sugary drink. and employees who did not receive proper background checks. however, when the nursing home was closed last week, most of the staff walked out with no arrangements made to care for the patients. >> how could somebody do that. we're talking human beingings. how do you just abandon them. >> reporter: . >> the sheriff's department says three employees stayed behind. a janitor, and two cooks. but they called officers a few days later when the patients were still there without proper nursing care. now investigators now considering filing elder abuse charges against the owner of the facility, so far the only comment from that side comes from an attorney that says the own owner is getting out of the nursing home business. reporting live in the news room, pam cook ktvu channel 2 news. time is 8:50. problems on mass transit, what's going on. >> caltrain is telling passengers to expect delays this morning and that's because of this broken down train. one of its southbound trains

broke down and just stopped north of the san mateo station, so trains are now single tracking, give yourself extra time. i have posted more information on twitter as far as all of the exact numbers of the trains. we have a traffic hazard in the south bay. this is in sunnyvale, a large chunk of cement is blocking a lane in the wolf road off ramp. it's slow going in patches, 101 southbound and then if we jet over to hayward, you can see a couple fender benders, nothing major. traffic not looking too bad except 880 southbound. this is the bay bridge toll plaza i want to mention with the metering lights are on. they have been since before 6:00 this morning. they went on a little bit early and we have major delays into san francisco. finally, highway 24 through lafayette. you can see traffic westbound on the right side of your screen, very sluggish as you drive toward the tunnel. 8:51. steve. tara: >> i really like that tie. >> thank you tara.
